Permanent residence

In accordance with the Law of Republic of Belarus of September 20, 2009 «On the Procedure for the Leaving of Citizens of Republic of Belarus from the Republic of Belarus and the Entry into Republic of Belarus», permanent residence of citizens outside Republic of Belarus is formalized by issuing a passport of a citizen for permanent residence outside Republic of Belarus and the registration of citizens permanently residing outside Republic of Belarus.

Registration of permanent residence outside Republic of Belarus of citizens whose right to leave Republic of Belarus is temporarily restricted is not allowed until the temporary restriction of their right to leave is removed.

The decision to issue a passport of a citizen of Republic of Belarus for permanent residence outside Republic of Belarus to a citizen who left Republic of Belarus for a temporary stay and who wishes to register his permanent residence outside Republic of Belarus is accepted by the diplomatic mission or consular office of Republic of Belarus.

Citizens who declared their desire to permanently reside outside Republic of Belarus prior to the registration of their permanent residence outside Republic of Belarus are required in accordance with the procedure established by the legislation of Republic of Belarus:

fulfill tax obligations;

to terminate the activity of an individual entrepreneur — for citizens carrying out such activities on the territory of Republic of Belarus;

obtain the consent of the military commissariat for the registration of permanent residence outside Republic of Belarus — for conscripts;

fulfill the alimony obligations with respect to individuals subject to the jurisdiction of Republic of Belarus, or regulate their relations with the said persons — for citizens who, in accordance with the legislation of Republic of Belarus, are obliged to maintain individuals subject to the jurisdiction of Republic of Belarus;

reimburse the expenses spent by the state on the maintenance of children on state security — for citizens who, in accordance with the legislation of Republic of Belarus, are obliged to reimburse such expenses. 

Registration of permanent residence outside Republic of Belarus for citizens who have reached the age of 14, who left for a temporary stay outside Republic of Belarus, is performed upon presenting the following documents:

application;

passport of the applicant;

birth certificate of the applicant;

two color photos of the applicant, corresponding to his age, with a size of 40x50 mm (one sheet);

certificate of birth of the child of the applicant — if the applicant has a child under 18 years of age;

certificate of change of surname, first name, patronymic — in case of change of name, surname, patronymic by the applicant;

certificate of marriage — in case the applicant is married;

certificate of divorce or a copy of the court's decision to dissolve the marriage — in the event of the applicant's dissolution of the marriage (if the marriage is terminated repeatedly — all evidence of divorce);

death certificate or a copy of a court decision declaring a citizen (citizen) deceased (her) in the event of the death of the applicant's spouse;

the written consent of the legal representative of the minor child of the applicant who is living in Republic of Belarus or the person in respect of whom the applicant is obliged to pay alimony for registration of the applicant's permanent residence outside Republic of Belarus, notarized, (in the absence of such consent, a copy of the court's decision on the possibility of the applicant's departure from Republic of Belarus for permanent residence outside Republic of Belarus without the consent of the said persons — if there are residents in Republic of Belarus republics of Belarus underage children of the applicant as well as those in respect of which the applicant is obliged to pay alimony);

applicant's work record card (if available);

document issued by a competent authority of a foreign state that confirms the applicant's right to reside;

document confirming the payment of the fee.

In addition to abovementioned documents, persons under the legal age should present:

passport or other document certifying the identity of legal representatives of a minor;

the written consent of the legal representative of a minor who does not register permanent residence outside Republic of Belarus jointly with a minor and resides in Republic of Belarus to register a minor for permanent residence outside Republic of Belarus, certified by an official of the Citizenship and Migration Department or certified by a notary in the absence of such consent — a copy of the court decision on the registration of a minor living outside Republic of Belarus without the consent of the legal representative, or a copy of the court decision on deprivation of the legal representative of parental rights, or issued by a body, conducting the criminal proceedings, the information on the wanted list of the legal representative, or a marriage contract or agreement about the children);

copy of the court decision to declare the legal representative of the minor dead or to recognize him as missing or a certificate from the registry office containing information from the record of the birth certificate if the record of the child's parents is made in accordance with article 55 of the Marriage and Family Code of Republic of Belarus if one of the legal representatives of the minor is absent;

documents confirming the residence of a legal representative of a minor in a state to which a minor leaves for permanent residence — in the case of a permanent residence outside Republic of Belarus of a minor without a legal representative.

In the case of permanent residence outside Republic of Belarus for citizens who have left Republic of Belarus for temporary stay outside Republic of Belarus, the legal representative (including father or mother) of a minor citizen of Republic of Belarus represents:

application;

questionnaire of a minor under the age of 14;

passport of a minor;

birth certificate of a minor;

passport or other document certifying the identity of legal representatives of a minor;

documents confirming the status of a legal representative of a minor who submits documents for registration of a minor to a minor outside Republic of Belarus;

two color photos of a minor, corresponding to his age, measuring 40x50 mm (one sheet);

in case the legal representative (including father or mother) does not register permanent residence outside the Republic of Belarus jointly with a minor, his written consent for the registration of a permanent residence outside the Republic of Belarus certified by a notary is necessary;

In the absence of such consent, it is necessary to provide a copy of the court decision on registration of a permanent residence outside the Republic of Belarus without the consent of the legal representative, or a copy of the court decision on recognizing such a legal representative as legally incompetent, or a copy of the court decision to deprive such a legal representative of parental rights, or a copy of the decision determination) of the court or criminal investigating authority on declaring the search for a legal representative, or the Marriage Agreement or the De s (their notarized copies).

death certificate of a legal representative of a minor or a copy of a court decision declaring the legal representative of a minor dead or recognizing him as missing, or a certificate from the registry office containing information from the record of the birth certificate if the record of the child's parents was made in accordance with Article 55 of the Code of Republic of Belarus on marriage and the family, in the event that one of the legal representatives of a minor is absent;

documents confirming the residence of the legal representative of minors in the state to which the minor leaves for permanent residence — in the case of a permanent residence outside the Republic of Belarus of a minor without a legal representative;

document issued by a competent authority of a foreign state that confirms the applicant's right to reside.

Documents issued by the competent authorities of foreign countries are accepted in case of their legalization, unless otherwise established by international treaties of Republic of Belarus, and translated into one of the state languages of Republic of Belarus in accordance with the procedure established by law.

The application fee is 175 euros.

The processing time for the application is up to 4 months.

After registration of permanent residence it is necessary to obtain a passport for permanent residence outside Republic of Belarus and to become a consular account at the diplomatic mission or consular institution of Republic of Belarus in the state of permanent residence, and in the absence of a diplomatic mission or consular office of Republic of Belarus in the state of permanent residence, representation or consular office of Republic of Belarus in another nearby state or in the main consular department of the Ministry of Foreign Affairs of Republic of Belarus in the manner established by the legislation of Republic of Belarus.
