Notarial actions

In accordance with the Law of Republic of Belarus of July 18, 2004 «On Notary and Notarial Activities» and the Consular Statute of Republic of Belarus, approved by the Decree of President of Republic of Belarus of February 19, 1996 №. 82, officials of diplomatic missions and consular institutions of Republic of Belarus have right to perform notarial acts.

Persons applying for commitment of notarial acts, submit documents confirming their identity, civil capacity, legal capacity of legal entities, authority to perform such actions on behalf of their own or other persons.

The notarial act is being committed in presence of information and (or) documents necessary for commitment of such an action, including confirming the payment of consular fee.

The table shows the rates of consular fees for the most common notarial acts. In the event that the required action is not specified, it is necessary to clarify the possibility of its commitment and the rate of consular fees at diplomatic mission or consular institution of Republic of Belarus.

Tax deductions for certain categories of persons under the consular fee are provided for by the Tax Code of Republic of Belarus (Special Part).

When issuing certain types of powers of attorney, the certification of contracts requires submission of additional documents. Texts of powers of attorney and applications are drawn up in accordance with the legislation of the Republic of Belarus in Belarusian or Russian languages.

For the performance of notarial acts, documents not complying with the requirements of the legislation of Republic of Belarus are not accepted, in particular: those having erasures, additions, crossed words, undecided corrections; executed in violation of the rules of record keeping; containing information discrediting honor, dignity and business reputation of citizens, as well as business reputation of legal entities.
